2. Scope
These Terms and Conditions govern use of the online store and the conclusion and performance of contracts for the purchase of goods offered through it.
“Customer” means a person placing an order. “Consumer” means an individual purchasing outside their trade, business or profession. Specific consumer rights apply to consumers as defined by law.
Customers must have the legal capacity required to enter into the contract. Anyone acting on behalf of another person must have the necessary authority.
Browsing the website does not create an obligation to purchase. Before submitting an order, customers are given the opportunity to read, save and accept these Terms and Conditions.
3. Product information
Product pages state the main characteristics, price and available variants of the goods. Customers select the desired model, size, colour and quantity.
Size charts relate to the specified brand, category or model. Use the measurement unit shown. Conversions between sizing systems identified as approximate are provided as guidance. For ski boots, follow the stated Mondopoint size.
Size charts assist selection but do not replace trying the product. This does not relieve the Seller of responsibility for accurate information or conformity of the goods supplied.
Display settings may affect how colours appear. This does not entitle the Seller to supply a different colour, model or specification without the customer's agreement.
4. Placing an order
Customers add selected goods to the basket, provide the necessary contact, delivery and invoicing details, and select from the delivery and payment options offered for the order.
Before final submission, customers can review and correct products, quantities and entered details. The total price, delivery charges and other applicable costs are displayed.
The order is submitted through a button labelled “Order with obligation to pay” or equivalent unambiguous wording indicating that placing the order entails an obligation to pay.
Customers are responsible for providing accurate details. If an error is discovered after submission, they should contact the Seller promptly. Changes after dispatch are agreed subject to practical possibilities and applicable terms.
Customers using an account should protect their login details and notify the Seller of suspected unauthorised use.
5. Order acceptance and contract formation
After submission, the customer receives an automated acknowledgement of the order. This message does not, by itself, constitute acceptance of the order for fulfilment.
After checking availability, the Seller sends a separate express acceptance. The contract is concluded when the customer receives that acceptance.
The confirmation includes the agreed products, price, delivery and applicable terms. These Terms and Conditions and the policies forming part of the contract, including withdrawal information and the model form, are supplied on a durable medium, such as an email or attachment that the customer can retain.
If goods are unavailable or an error is identified before acceptance, the Seller informs the customer. An alternative product, price change or partial fulfilment requires express agreement. If the order is not accepted, any payment received is refunded without undue delay.
Once the contract is concluded, the Seller cannot arbitrarily cancel it or unilaterally change the agreed terms. Statutory grounds and legally permissible contractual provisions apply.
Contracts are concluded in Bulgarian. The English version is provided for convenience and does not restrict mandatory consumer rights.
6. Prices and promotions
Prices are stated in euros and are final consumer prices inclusive of VAT at the applicable rate. Delivery and other applicable costs are displayed separately before the order is submitted.
Conditions for discounts and promotional codes, including duration, eligible products, minimum order value and whether offers can be combined, are stated for each campaign.
When announcing a price reduction, the previous price is determined according to applicable law. Promotional conditions do not restrict consumers' statutory rights.
A subsequent website price change does not alter the price under a contract already concluded.
7. Payment
Customers choose from the payment methods shown as available for their order. The conditions and any permissible charges associated with the selected method are provided before final submission.
Where bank transfer is offered, bank details, the payment reference and deadline are provided during ordering and in the confirmation. If payment is not made within the agreed period, the Seller notifies the customer and acts according to the agreement and applicable law.
For card payments, customers follow the payment provider's procedure. Do not send card numbers, security codes or verification codes by email or chat.
The required payment and accounting documents are supplied for the purchase.
8. Delivery and receipt
Available delivery areas, methods, charges and times are stated before order submission. Any free delivery conditions are expressly announced.
For bulky goods or products subject to special arrangements, the relevant charges and delivery times are provided before the contract is concluded.
Unless another period is agreed, goods are delivered without undue delay and no later than 30 days after conclusion of the contract. In the event of delay, consumers have the rights provided by law, including setting an appropriate additional period and terminating the contract if delivery is not completed. No additional period is required in the cases specified by law.
The risk of accidental loss or damage passes to the consumer when the goods are received by the consumer or a designated person other than the carrier. The statutory exception applies where the consumer independently commissions a carrier not offered by the Seller.
We recommend inspecting the parcel on receipt and recording visible transport damage with the courier. Failure to inspect or obtain a report does not remove statutory consumer rights.
9. Separate policies
The following documents address their respective subjects in detail and are made available before the customer places an order:
- Returns and Exchanges — withdrawal, returns, refunds and exchanges for a different size or model.
- Guarantees and Complaints — statutory conformity rights, commercial guarantees and complaints.
- Privacy Policy — processing of personal data.
- Cookie Policy — use of cookies and similar technologies.
The Returns and Exchanges Policy and the Guarantees and Complaints Policy form an integral part of the contract in the versions supplied when it is concluded. Acceptance of these Terms and Conditions does not constitute consent to marketing or optional cookies.
10. Specialist equipment
When using climbing, mountaineering, skiing, avalanche safety or other specialist equipment, follow the manufacturer's intended use, instructions, compatibility restrictions, inspection requirements and service life.
Product descriptions do not replace necessary training, professional fitting or technical inspection. Fitting, customisation and servicing, where offered, are agreed separately with clear terms and pricing.
These instructions do not exclude the Seller's statutory responsibility for faulty, unsafe or non-conforming goods.
11. Website content and liability
Rights in text, images, trademarks and other content belong to the Seller or the respective rights holders. Use beyond what is permitted by law requires the necessary authorisation. Customers may retain the contractual documents supplied to them for their own records.
External links may lead to independent websites with their own terms. This does not relieve the Seller of its obligations under the contract.
Nothing in these Terms and Conditions excludes liability that cannot lawfully be restricted.
12. Applicable law and disputes
For questions or disputes concerning an order, customers may contact the Seller at info@adventure-shop.bg or by telephone on +359 879 664181.
Bulgarian law applies without depriving consumers of mandatory protection available under applicable rules. The competent court is determined by law. Out-of-court resolution does not restrict the right to seek judicial protection.
Where a consumer dispute cannot be resolved directly, the Seller supplies the required information on the relevant alternative dispute resolution body and its participation in the procedure on a durable medium.
13. Amendments and final provisions
New versions of these Terms and Conditions are published with an effective date and apply to future orders. Existing contracts remain subject to the terms accepted when they were concluded, except where a subsequent agreement is permitted by law.
Continuing to browse the website does not automatically amend an existing contract.
If an individual provision is invalid, the remaining provisions remain applicable where the contract can continue without it. Matters not addressed here are governed by applicable law.
